The U.S. Supreme Court let stand on January 10, 2005 a ruling that the Ku Klux Klan can take part in Missouri's 'Adopt-A-Highway' program in which volunteers pick up trash along the road and the state puts up a sign thanking the group. Without comment, the high court rejected Missouri's appeal of a U.S. appeals court ruling that declared the state had violated the Klan's constitutional free-speech rights. From a 1st Amendment point of view, this case was pretty much a slam dunk. If MO elects to allow groups to volunteer to clean up stretches of its highway rights-of-way, it can't deny participation to particular groups based on belief, even groups whose views the state finds abhorrent. Of course, no state has to have an adopt-a-highway program, and some states have cancelled theirs for this very reason.

A lawyer friend who has followed this case for some time said to me that MO should let the KKK volunteer, figuring they won't last long in the face of the "abuse" that is sure to follow. ;)

We had a similair case in VA a few years ago when a gay/lesbian group and the KKK both volunteered at the same time. Th ecounty's lawyer decided there was real basis for denying either group under the guidelines for participation in place and it never went to court.
