The former. Which is why Mattel filed a lawsuit if I recall.

Then later used that song in their own advertising.

I'll listen to it later. I have always avoided this band because of the similarity in name to Nightbringer, a black metal band from Colorado with some outstanding material.

I don't understand why so many melodeath bands seem to be winter-themed. Most of them sound generally so cheerful that they sound more like summer.
