Title: Decree of Nullity
Post by: Mickey on March 26, 2009, 10:11:18 AM
I am unable to find any information regarding the Latin Catholic practice of granting a "Decree of Nullity" (marriage annulments).  My research on the history of this practice reveals nothing!

When did the "decree of nullity" first come into existence? Was there such a process in the first millennium?

Could it have been established at the Council of Trent?

Does anyone know anything about this?

The Catholic Encyclopedia article on Divorce (http://www.newadvent.org/cathen/05054c.htm) has a section on the decree of nullity (#4), replete with references to papal encyclicals and church councils.

Unless I am reading it incorrectly, it seems that the early Church let the bishops decide and a bit later it was an ecclesiastical judgement (much like the Orthodox Church). But today, the Latin Church follows the constitution of Benedict XIV, Dei Miseratione from Nov 3, 1741.

 ???
